If you're in the US, it depends on individual state laws.

The laws change everywhere so it depends 100% on where you live.
In some places it's completely illegal. In a lot of others it's perfectly fine as long as nobody is charging a rake. You've gotta look it up for your particular location.

As others said, varying states have varying rules regarding it. A rake is pretty much a sure fire way to say you are illegal in any state.

A: The congressmen and state legislative representatives of where the game is being played.
Write your local representatives and lobby for it to be legal if it is not already. Trust me, you won't be the first to do so, and they need your vote too.

It's the laws that each state have that make it legal. I know some states are looking at making some changes, because some laws are so strict it's crazy.

I can't see how a group of friends and a couple of invitees over the house to play for a few bucks and a few laughs would be anywhere close to illegal.

There is always a potential for these small home games to become dangerous. I would never invite someone to a home cash game that I didn't personally know for awhile.
In the news the police were cracking down on home games due to gangsters breaking into the homes and robbing the players at gun point. This was last summer I believe (?) I know someone else may have better memory than I do. Maybe if someone had a link to that old article?

but the main concern is just not getting caught, as long as you dont invite any police over you should be alright

If you are playing with your friends it's fine and you'll never have to worry about the law.
The laws are in place to stop "underground" card rooms from popping up. For example having games ran out of your basement with multiple cash tables 24/7 and charging rake would definitely be illegal.
