It's not even clear that poker is illegal gambling but as of now banks simply overblock because there is no penalty for overblocking and there is a penalty if they don't attempt to block and they are sued/audited/whatever happens. The PPA among other things is currently bringing a suit to attempt to clarify just that. If a court can rule that poker is not illegal gambling, hopefully the banks will not block the transactions.
