Poker is chiefly a game of luck, not skill, a jury decided yesterday in a landmark ruling.

Derek Kelly was convicted of breaching the 1968 Gaming Act by hosting games at his private club

It states that a licence is needed to host games of chance, like blackjack or roulette - but not Chess and Quiz Machines.

The trial was seen as a test of whether or not Poker should fall under the Act.

Mr Kelly's defence argued that skill was needed to play poker successfully - but the prosecution said that once the cards were shuffled, a "significant" element of chance had been introduced..

Mr Kelly was convicted of organising a game in which a "winning's levy was charged" and of organising a game in which a players fee was charged.

Mr Kelly said "We will still be playing at the Gutshot tonight. We may have to change the way we do it"

He will be sentenced on 15/02/07

I`m facing a similar situation because I intend to open a Poker Room in my location, the problem is, they have the game under the laws of Casino Games, which makes you subject to very expensive Fees and taxes. I would totally argue that it is a game of 80% SKILL(this includes, statistics, mathematics, and psychology) and 20% luck. Any ideas on how to Fight this Decision in Any form is Highly appreciated, and thank you ;)

Unfortunately, tho you would try to argue 80%skill/20%luck then still luck is involved which categorizes it as a game of chance. Unlike any sport including chess wherein zero luck is involved & wins by simply out-performing opponents.

Luck is important but isnt definitive is a variable like other stuff.
U can play bad and win one tournament and play good and lose in few hands

This particular 1 post thread that you've chosen to revive is 16 years old! Why did you choose to bring this one back from the dead? (there are plenty of other posts re: luck vs skill, %luck, %skill).

I fully share your opinion, in my case I also depend much more on luck than on any other sense, maybe my game is not good but I feel that everything depends on luck even though I know it can't be real

There will always be an element of Luck when playing games of chance, when you shuffle 52 cards and hope to get the 2 cards that mean the difference between winning or losing at a Poker table then the combinations run into the Millions, But the skilful player will win more times than the luckiest players.
That is why some players become Professional players and make a living from the game. They don't need to win every game, just finish in the money more often than the lucky players.

This may be a record on CardsChat for most dead thread being resurrected - after 16 1/2 years.

But it did get me to look up Derek Kelly. He was fined $10,000 British Pounds, which he ended up paying $500 British Pounds a month until paid off. He also has just 1 entry on The Hendon Mob from 2015.

EDIT: I spoke too soon. Luckyfish is rezzing threads from 2005, too, lol.
