Maybe the rule should state that the hand for player Z is compared to the hands for players X and Y; if Z could not have beaten either X or Y, then fine, Z is out. But if he could have beaten just one of the hands, then the pot is his. I suppose so. Hopefully it doesn't happen that much in actual play.
