Actually, that was a court decision in Rio de Janeiro, not São Paulo.

There were recent court decisions in São Paulo saying Poker can be classified as gambling so it is up to cities to decide to give a license to cardrooms to operate, meaning they are allowed to refuse to give them.

Poker is in a grey area in Brazil so one single decision in state level doesn't mean poker is legal or illegal.

Governments try to find excuses to ban or strictly control poker , casino or other formats of gambling , that's bad . But yes , when it comes to poker , it's more skill than luck , at least at tournament and on the long run for sure
It's sad what happens in some countries with all the restrictions. Hopefully one day things will become better , leke they used to it , free gambling , decide free where to spend your money , or time .

We can play semantics or delude ourselves all day long but poker is gambling. Yes it requires skill so it is also a game of skill but the gambling aspect is too large to be overlooked. The two things are not mutually exclusive as many seem to think. And it does no service to poker to deny that. Or deny how it started, took shape and got popularized originally. As a lot of things in life playing poker for money requires personal discretion. Thus, poker should be available to all of age if they so choose to indulge and I am against any government bans on it. Rather I am for government regulation so shady practices do not get a foothold robbing players.

Restrictions on poker playing in many countries have to do with a lot of politics which has nothing to do with the game itself or poker clients themselves. And that is the biggest problem in that regard. But let us not do mental gymnastics to make poker legal in all places. That also can not be the right thing to do. But rather, lets deal with often nonsensical politics.
