As of March 2025, the state has pacts with the Sisseton-Wahpeton Sioux Tribe, the Spirit Lake Tribe, the Standing Rock Sioux Tribe, three affiliated tribes (Mandan, Hidatsa, and Arikara), and the Turtle Mountain Band of Chippewa Indians.
These pacts allow Class III gaming which includes electronic games of chance, blackjack, poker, pari-mutuel wagering, sports, Calcutta pools, pull-tabs or break open tickets, raffles, keno, punchboards, paddlewheels, craps, and roulette. They went into effect in 2013 and had a 10-year term. In 2022, new amendments were announced, which are set to expire in 2032. These tribes also offer sports betting.
Sweepstakes casinos are the only way to have a casino-like experience online in North Dakota. There have been attempts to expand gaming in the state. Senate Bill 2376 would’ve expanded Turtle Mountains' gaming abilities, but it died in the Senate.
